Proposals afloat to increase qualifying period for unfair dismissal claims from one to two years

Recent press reports have suggested that the government is proposing to increase the qualifying period that an employee needs to work before bringing a claim for unfair dismissal from one to two years. We have been there before, as the qualifying period was two years prior to 1999.

Employers may welcome the proposals as it would mean a reduced obligation to carry out a reasonable process based on a fair reason when considering dismissal of an employee of less than two years service. However, the proposals should be met with some caution as claims such as discrimination or whistle blowing do not require a qualify period and employees may choose to bring a claim for, for example, discrimination, where they have insufficient service for a claim for unfair dismissal. That claim would be, for the employer, more expensive and time consuming to defend. 

In addition, the government is proposing a claim fee to act as a disincentive to issuing claims with little prospect of success. Some suggest this may be as much as £500 while others suggest it shall be based on the employee’s pay. Inevitably, should the claim succeed, that cost would be passed on to the employer.

The suggested changes are in response to pressure from employers regarding spurious claims made by employees and also in response to the surge in claims at the Tribunal. However, the changes are unlikely to significantly reduce the number of overall claims issued as employees will instead make claims that require no qualifying period. 

In any event, employers should seek legal advice when dismissing employees with insufficient service as an employee’s notice period may bring their service over the two year period.

Michael Burdett on BBC Four's Retrial By TV: The Rise & Fall of Rough Justice

On 3rd April 2011, Michael Burdett, Consultant with Hanne & Co's Criminal Department, appeared on BBC Four's Retrial By TV: The Rise & Fall of Rough Justice.  Rough Justice was a long running BBC TV series which investigated alleged miscarriages of justice.  It aired between 1982 and 2007.  The series achieved the overturning of convictions of 18 people in 13 separate cases.  Rough Justice also contributed to the establishment of the Criminal Cases Review Commission in 1997, an independent body created to review possible miscarriages of justice and refer appropriate cases to the appeal courts.

Retrial By TV: The Rise & Fall of Rough Justice featured the case of Michael Burdett's client Mervyn Russell.  In December 1983 Mervyn Russell walked free from prison having served 6 years of a life sentence for a murder he did not commit.  He was the first person in Britain to have a conviction quashed as a result of a single TV programme.  In 1982 the first Rough Justice programme "The Case of the Handful of Hair" covered Mervyn Russell's story.  The Rough Justice programme and Mervyn Russell's defence team gathered and presented fresh evidence to the Court of Appeal which quashed his conviction.

Speaking of the programme Michael Burdett said "the programme shows just how far we have come since the days of ‘Life on Mars’, but we should not be complacent because the CCRC is losing funding. I am very proud that Hanne & Co helped to pioneer this change of attitude towards miscarriages of justice”.

Ex-Solicitor of Hanne & Co and Olympic Swimmer Dies

Roy (Royston) Romain has died recently at the age of 92.

Mr Romain was a solicitor with the firm after the Second World War (during which he rose to the rank of Lieutenant Colonel). He was in his time the British and European 200m butterfly champion and one stage held the world record. He competed in the 1948 London Olympics narrowly missing out on a place in the finals.

He continued to swim and competed in the British Master Championships and swam regularly every week up to few weeks before his death.

Hanne & Co Sponsored Walk 16th May 2011

As a firm with a continued and dedicated commitment to charitable causes, Hanne & Co is following up on the roaring success of February’s sponsored walk with yet another walk. 

On 16th May 2011, there will be an estimated 220 teams setting off for the 10km walk from the Royal Courts of Justice in a round trip ending at the Law Society to raise funds for London Legal Support Trust. Walkers include prominent members of the legal profession, including:
